An  Investigative report of HRCBM- Dhaka conducted at village Agarpur Das Para, P.S. Kuliarchar, Dist. Kishoreganj, Bangladesh.

Allegation:  Ms. Nilu Rani Das (32) a widow with her niece Ms. Popy Rani Das (17) were gang raped, paddies rice and betel nuts looted by terrorists – Alaluddin, Jalaluddin and others at village Agarpur Das Para, P.S. Kuliarchar, Dist. Kishoreganj on 26thof January, 2004.

The Report:

I, Adv.Rabindra Ghosh of HRCBM, Dhaka got information on the way to Bhairab Bus Terminal after conducting investigation of incident of gang-rape at Barshagati within Pakundia P.S. on 7th of February, 04 through Arjun Bhowmik of Agarpur Daspara, Kuliarchar P.S. that Ms.Nilu Rani Das along with her niece Ms. Popy Rani Das of the same village have been gang raped by some local terrorists and their paddies, rice and betel nuts have been looted and they have been intimidated and threatened for life. We got information on on 7th but could not proceed to the spot due to shortage of time.

I along with Ms.Biva Rani Biswas to-day (13th of February,04) at 7 a.m. proceeded to Agarpur Daspara of Kuliarchar by Bus 250 kilometers from Dhaka
within the district of Kishreganj and reached at the spot at about 2 p.m. and got a good number of witnesses regarding the incident of gang- rape, repression
and looting on the minority family and investigated the matter. The statements of the victim Ms. Nilu and her family members, witnesses found available on the
spot have been videotaped, pictures taken by our team.

Background Information :

Sunil Kumar Das expired one year ago and he left behind wife – Ms. Nilu Rani Das, two minor sons namely 1) Subir Das (13) student of Class VIII and Shuva Das (8) a student of Class II and mother – Abala Rani Das (80). After the death of Sunil Kumar Das – the family members became helpless and they live on agriculture. They are very peace loving, law-abiding minority inhabitants of the locality. They have got half decimals of agricultural land and somehow they manage to their livelihood. But the Muslim neighbors of the same locality cast their eyes on the small landed properties Ms. Nilu Rani Das and were trying to grab the homestead also on different occasions. There was no previous enmity or litigations between the destitute family and the neighboring Muslims. The complaint filed by the victim on 27th of January 04 does not indicate any previous enmity. But the complaint made written subsequently on 9th February, 04 by the victim somehow with motive only to eye wash the situation.

Ms. Nilu Rani Das and Ms.Popy were gang-raped by 9 rapists :

On the last 26th of January,04 at about 1 a.m. some local terrorists namely
1) Alaluddin
2)Jalauddin
 3)Azam Ali
4) Ahmed Ali
5) Shamsuddin
6) Abu Bakar
7) Bacchu Meah
 8) Zillu Meah and 9) Bakkar Meah
and more 5/6 unknown persons of Agarpur and Barakanda, P.s. Kuliarchar, Dist. Kishoreganj broke open the door by sharp weapons and entered into the house of the victim . The rapists namely Alaluddin son of Late Azam Ali Shamsuddin , son of late Razat Ali, Nuru Meah son of late Suruz Ali and Ahmed Ali son of late Ayub Ali and 2 others caught hold of Ms.Nilu Rani Das and Ms. Popy Rani Das, got them out of the house and laid them down in the ground and started to rape one after another. As a result Ms. Nilu Rani became senseless and some other terrorists looted 40 mounds of paddies from the” Gola”
amounting to Taka 8,000/- from the house of victims. The terrorists showed them iron rods, dao, knife and deadly weapons and went away after 2 hours operation in the night. The terrorists also warned the inmates of the house that if any case is filed in the police station and if matter is reported to police the minor children of Ms. Nilu Rani Das namely 1) Subir Das – student of Class VIII and 2) Shuva Das – student of Class II of Kuliarchar High School will be abducted and killed.

Ms. Nilu Rani Das was found unconscious by the Doctor :

The villagers found Nilu Rani unconscious because of repeated rape upon her and took her to the local doctor. Mr. Paritosh Bhowmik, the local physician examined her and sent her to local Thana Health Complex for medical treatment. Ms. Nilu Rani was treated but could not come back to her home as the  terrorists were threatening her for life. We also asked Paritosh Bhowmik and he told us that the incident of brutal rape is constantly increasing and further aggravated by the lack of governance and prejudice.

We asked Nilu Rani about the incident of rape. She disclosed us that the names of the accused stated above are responsible for his injury and loss, which
cannot be compensated by money. She described us that she could recognize 1) Shamuddin 2) Alaluddin 3) Nuru Meah and 4) Ahmed Ali while they one after another raped her and she could not say anything as she became senseless.
Ms.Nilu Rani- also told us that Ms.Popy Rani is a relative and she was the private tutor of her two minor children and also a Student of Higher Secondary
School (First Year) and she stayed with her on the same night and unfortunately she was also gang raped by the rapists. But we could not find Ms. Popy Rani in the locality to put question on her, later we came to know that she does not want to lodge any FIR in police station because of his chastity. While Ms. Nilu
Rani was describing us such story of heinous offence she was crying loudly and complained our Women Wing H.R. activists Ms. Biva Rani Biswas that “ I have lost everything; I have none to look after, I have nothing to eat now. Who will look after my minor children and will give them education? When my children will be grown up then what reply would be made to them? This was the pathetic utterance of the victim Ms.Nilu Rani with broken heart. We paid an amount of Taka 2000/- for her temporary subsistence.

We have also found and examined the following witnesses of the locality: -

All the above witnesses deposed that Ms. Nilu Rani was gang raped and her belongings have been looted by the terrorists on 26th night of January,04. All of the witnesses told us that the offence committed by the known terrorists are true and there is no previous enmity between the victim and the terrorists. But it is astonishing that the F.I.R. lodged earlier by the victim was not timely and properly registered in Kuliarchar police station. The first complaint was filed to a Sub-Inspector of Police on 27th of January 04 at Kuliarchar P.S. but the S.I. of Police did not register the case in time, kept the FIR at his custody and left for home due to “Eid-u-Zoha” festival without taking any steps against the rapists and criminals responsible for the offence.

Statements of Md.Nabi Hossain – Officer-in-Charge of Kuliarchar Police station :

We have also gone to Kuliarchar Police Station 10 kilometers from the place of occurrence. We found the O.C. and asked why the case was not registered in time and proper manner in his police station. He told us that the previous complaint has been modified and on 9th Feb,04 a F.I.R. has been re-written and signed by the victim and case has been filed as Kuliarchar P.S. case No.3 dated 9th February,04 under section 9(3) of Nari-O-Shishu Nirjatan Ain, 2000 read with section 143/447/448/380/350 of Bangladesh Penal Code against 9 accused and unknown 5/6 and action will be taken against them. He also told me that the wearing sharee of the victim Ms. Nilu has been seized by police. When asked, why the Sub Inspector initially neglected to register the case and the delay thereof, the O.C replied that he is not aware of the F.I.R. filed earlier before the P.S.
I also told him as to why the terrorists have not yet arrested since the occurrence took place on 26th of January 04. He replied that he is trying to apprehend the accused but the accused are absconding. We also requested the O.C. to recover the looted articles from the possession of the criminals, but the O.C. told us that he will try his best to do so. We took both copies of FIR and found that the FIR filed later on is far from satisfactory which may cause damage to proper justice to the victims. Facts incorporating in the FIR lodged later on with previous enmity is far from truth. We came to know that the local administration tried to put pressure on the victim and the accused for a compromise during this period and they tried to negotiate the matter within the political parties, but failed and as a result the FIR filed later on taking signature of the victim incorporating some false plea.

No F.I.R. was filed by Ms.Popy Rani Das :

I also asked the O.C. Kuliarchar why the FIR was not filed by anybody although there are specific allegations against the rapists. O.C. replied us that  Ms.Popy Rani Das was examined by O.C. and she expressed that she has been raped, but she did not like to register any case nor she want to be examined by any doctor nor she want to appear before any Magistrate for recording 164 statements. I told the O.C. that if any cognizable offence takes place within
his jurisdiction it was the duty of the O.C. to take case on his own behalf. In that case police may take case on behalf of the complainant and complainant’s
presence is not so essential. O. C. did not reply. We observed that a suppression of facts in the preliminary stage of filing complain in due process of law will be fatal for the justice-seekers. Due to lack of proper and accurate process of filing of complaint in the police station, most of the cases ended in smoke and the justice seekers may be deprived of that opportunity. As a result the accuseds responsible for the offence may easily
come out and being acquitted from the charge and they get more enthusiastic and
strength to commit further offence in the society.

Statements of minor boys of Ms.Nilu Rani Das and her mother-in-law :

We asked surviving minor Subir Das (12) and Shuva Das (6) of the family who told us that on the night of occurrence they have been warned not to move by
the terrorists and some terrorists put tremendous pressure, clothed them with warm blankets not to more and in their presence their mother was forcefully
unclothed and the rapists one after another raped her. They also showed them dao, kirish, knife and deadly weapons and one terrorist namely Alaluddin gave a
severe blow to Subir on his face, as a result he became injured. We also asked 80 years old Ms.Abala Rani Das – mother-in-law of Ms.Nilu Rani Das who can not even move she was also kicked down by one of the terrorists Baccu Meah and as a result she fell down and got multiple injury. We examined her and found that she is not capable to walk. We gave Ms.Abala a little money for her treatment.

Ms.Nilu Rani , her minor two sons and mother-in-law should be protected and  justice should be mete out :

We on behalf of HRCBM urge upon the Government of Bangladesh and the conscious people of the world to come forward for the safety of Ms.Nilu Rani Das, his two minor sons namely Subir Das and Shuva Das , and her mother-in-law Ms.Abala Rani Das (80) should be protected. All sorts of security measures should be taken for their lives and property of the destitute family. All criminals responsible for heinous offence as stated above should be punished.
They want to live in Bangladesh with full dignity and prestige. The Government of Bangladesh should be requested for the protection of rights of minorities as per resolution adopted in UN by the General Assembly in its resolution 47/135 of 18th December, 1992. The written statements as an appeal duly signed in by the victim family may kindly be considered sympathetically.

During our visit to the spot (Agarpur Das Para), Kuliarchar police station and the general public we have been given to understand that some  interested persons irrespective of all political affiliation in the locality are trying to suppress the matter and nobody is sincerely working to do justice to the destitute family.

In the Appeal, Ms. Nilu seeks the immediate intervention of International Community to save her life. She alleged that accused terrorists are not not apprehend by police perhaps due to unholy alliance.  she asserted how terrorist attacked and gang rape her.
She complains on the denial of justice by the police and local administration. She further stated, in the meantime, HRCBM reached the spot, provided some money and assured me of justice. Through this appeal, Ms. Nilu has begged to world community for help, justice and guarantee to live a peaceful life.
She has also duly signed the paper to proclaim the truth.
