Please follow this sample letter to write to the government of Bangladesh. The Hague, 20 April 2004 Your Excellency, On behalf of ? I would like to urge your government to sign the Agreement on the Privileges and Immunities of the International Criminal Court before 30 June 2004, which is the deadline for signature. The Agreement on the Privileges and Immunities of the International Criminal Court is a key document within the Rome Statute system and provides for such privileges and immunities as are necessary for the fulfilment of the Court?s purpose. As stated by the President of the ICC, Judge Philippe Kirsch, at the Second Session of the Assembly of States Parties to the Rome Statute of the International Criminal Court (22 April 2003): ?While the Rome Statute was clearly the sine qua non of the ICC, the Agreement on Privileges and Immunities is now of increasing importance as the Court begins its work in earnest and I call on States Parties to accelerate the ratification of this key agreement.? We echo the statement of the President, and urge you to see the signature as a first important step, to be followed by an early ratification and proper implementation of the Agreement. The Agreement is very similar to the Convention on the Privileges and Immunities of the United Nations, but tailored to the special needs of the ICC. The APIC is needed because the ICC is a new and independent international organization. The fact that the Agreement is not in force, and only ratified by 7 States, is already providing for complications for the Court, as the Prosecutor and ICC begin to respond to referrals and to examining situations in particular countries. Without privileges and immunities, investigators and other staff will be considerably hampered in their ability to carry out activities on the ground. In addition, counsel, victims and witnesses are particularly vulnerable when participating in the Court?s activities without the protections contained in the Agreement. Sincerely,
