March 16, 2025 — In a critical move to protect minority communities from escalating legal persecution, the Human Rights Congress for Bangladesh Minorities (HRCBM) has officially served a legal notice to the Government of Bangladesh, demanding urgent intervention against the widespread registration of false and malicious cases targeting ethnic and religious minorities.
Filed through Barrister Khan & Associates on March 16, 2025, this Notice Demanding Justice has been served upon:
The Secretary, Ministry of Home Affairs, Public Security Division
The Secretary, Ministry of Law, Justice and Parliamentary Affairs
The Chairman, National Human Rights Commission
The Inspector General of Police
The Growing Crisis: Abuse of Legal Processes Against Minorities
In the past months, Bangladesh has witnessed a surge in horrific and unprecedented incidents against minority citizens, including:
Forced land grabs and property looting
Arson attacks and abductions
Extortion, job dismissals, and forced displacements
Rape, murder, and widespread harassment
Of particular concern is the systematic misuse of the legal system, where law enforcement agencies are filing numerous fabricated cases against innocent minority individuals. These false cases have been weaponized to harass, intimidate, extort, and socially isolate minorities, causing grave psychological, social, and economic harm.
In many instances, minority victims are threatened with prosecution unless they meet illegal demands, further eroding their safety and dignity. This deliberate abuse undermines the very foundations of justice, violates constitutional protections, and threatens Bangladesh’s commitment to the rule of law and social stability.
HRCBM's Urgent Demands to the Government
The legal notice, issued under the authority of Advocate Lucky Bachhar, Convenor of HRCBM’s Bangladesh Chapter, demands the following immediate actions:
Immediate Suspension of False Case Registrations:
All police and administrative authorities must refrain from registering false or frivolous cases without proper verification.Thorough and Impartial Investigations:
No case should be registered without a rigorous and impartial investigation adhering to due process standards.Review and Withdrawal of False Cases:
A mechanism must be established to review all cases filed since August 5, 2025, with false or malicious cases to be withdrawn immediately. Innocent individuals must be released unconditionally and their reputations restored.Accountability for False Accusations:
Legal provisions must be introduced and enforced to punish individuals responsible for filing false cases or providing perjured testimony, deterring future misuse of the justice system.
Call to Restore Justice and Rule of Law
HRCBM firmly asserts that collaboration between law enforcement agencies and judicial authorities is essential to restore public confidence in Bangladesh’s justice system. Only by upholding due process, human rights, and equality before the law can Bangladesh move toward true social harmony and national development.
HRCBM has given the authorities seven days to respond and take necessary corrective measures. Failing which, HRCBM will proceed with legal action, including filing a Writ Petition before the Hon’ble High Court Division of the Supreme Court of Bangladesh to seek judicial redress for the persecuted communities.
